PENAMALUT.COM, TERNATE – Penyidik Direktorat Polisi Perairan dan Udara (Ditpolairud) Polda Maluku Utara menetapkan dua orang sebagai tersangka dalam kasus tenggelamnya kapal KM. Cahaya Arafah di perairan Desa Tokaka, Kabupaten Halmahera Selatan, Senin (18/7) lalu.
Kedua tersangka ini yakni, Nakhoda KM. Cahaya Arafah Andika, dan pemilik kapal berinsial Is alias Iskandar.
Direktur Ditpolair Polda Malut, Kombes Pol R. Djarod Riadi melalui Kanit II Subdit Gakkum, Ipda Adegair Ibrahim menyampaikan, awal proses penyelidikan dilakukan sampai pada tingkat penyidikan dimulai dari pemeriksaan saksi-saksi.
Setelah pemeriksaan saksi, dilakukan gelar perkara pertama pada Rabu (21/7). Dari proses penyelidikan itu kemudian ditingkatkan ke penyidikan berdasarkan fakta dan bukti yang ada.
Tahap penyidikan, kata dia, penyidik juga melakukan gelar perkara kedua pada Selasa (26/7). Setelah gelar perkara kedua baru dilakukan penetapan tersangka.
“Untuk sementara dua orang tersangka itu Nakhoda atas nama Andika dan pemilik kapal Haji Iskandar,” ungkapnya saat ditemui di ruang kerjanya, Senin (1/8) tadi.
Menurutnya, satu dari kedua tersangka, yakni Nakhoda kapal Ansika, sudah dilakukan penahanan. Sementara pemilik kapal rencana dilakukan pemeriksaan sebagai tersangka hari ini, Senin (1/8), hanya saja berhalangan atau sakit dan sudah dikonfirmasi oleh pengacaranya belum bisa hadir.
Kedua pelaku ini dikenakan Pasal 302 ayat 1, 2, 3 junto Pasal 117 dan Pasal 310, Pasal 312 junto Pasal 145 Undang-Undang No 17 Tahun 2008 tentang Pelayaran, dan Pasal 359 junto Pasal 55 ayat 1 ke 1 KUHPidana dengan ancaman maksimal 10 tahun penjara.
“Untuk perkembangan seperti apa selanjutnya, kita tunggu dari pengacaranya. Yang jelas nakhoda kapal sudah ditahan,” jelasnya.
Soal tersangka lain, kata Adegair, nanti pada proses pendalaman dan pengembangan ke depannya.
“Tidak menutup kemungkinan, tapi masih dalam proses pendalaman. Tetap pada porsi dan prinsip praduga tak bersalah,” tukasnya.
Sejauh ini, penyidik Ditpolair telah memeriksa 12 saksi. Dari jumlah saksi tersebut sudah termasuk agen kapal bersama petugas Syahbandar pos Bastiong.
Sekadar diketahui, tenggelamnya kapal KM. Cahaya Arafah yang mengangkut 77 penumpang itu menyebabkan 10 orang meninggal, satu masih hilang, sementara 66 orang lainnya selamat. (*)
