PENAMALUT.COM, TERNATE – Empat terdakwa perkara dugaan korupsi pembangunan Bendungan dan Irigasi Desa Kaporo, Kabupaten Kepulauan Sula, menjalani sidang perdana di Pengadilan Tipikor Negeri Ternate, Rabu (2/3).
Sidang dengan agenda pembacaan surat dakwaan dari Jaksa Penuntut Umum (JPU) itu dimulai pada pukul 16.04 sampai 17.20 WIT sore tadi. Sidang digelar secara tatap muka dan virtual yang dipimpin Ketua Majelis Hakim Rudy Wibowo didampingi dua hakim anggotanya, Iwan Anggoro Warsita dan R. Moh. Yakob Widodo.
Dua orang terdakwa hadir secara tatap muka, yakni terdakwa Masykur Hi. Hasan Soamole alias Masykur selaku Pejabat Pembuat Komitmen (PPK) dan dan Razak Karim selaku Direktur PT. Amarta Maha Karya, rekanan yang menangani proyek tersebur.
Sementara Ferdi Parengkuan alias Ferdi selaku pelaksana pekerjaan yang juga oknum anggota DPRD Sula dan Moh. Luthfi A. Kadir selaku mantan Kepala Dinas Pekerjaan Umum, Penataan Ruang, Perumahan dan Kawasan Pemukiman (PUPRKP) Sula tahun 2018-2019 sekaligus Kuasa Pengguna Anggaran (KPA), mengikuti sidang secara virtual.
JPU Maikel F.K dan Ismail dalam membacakan dakwaan itu mengatakan, empat terdakwa didakwa dengan dakwaan primair dan subsidair yang semuanya sebagai terdakwa berkas perkaranya diajukan secara terpisah atau splitzing.
Berdasarkan pemeriksaan dari tim teknik pada Direktorat Jenderal Sumber Daya Air Balai Wilayah Sungai Maluku Utara pada Kementerian Pekerjaan Umum Dan Perumahan Rakyat (PUPR), terdapat pekerjaan fiktif (tidak dilakukan) dan atau ketidaksesuain volume kontrak dan fisik di lapangan sebagaimana yang tertuang dalam kontrak pada dokumen ADD 03.
Berdasarkan hasil penghitungan kerugian keuangan negara dari Badan Pengawasan Keuangan dan Pembangunan (BPKP) Perwakilan Malut atas pekerjaan pembangunan Bendung dan Jaringan Irigasi Kaporo tersebut terdapat Kerugian Negera sebesar Rp 1.820.519.119.
Pada dakwaan primair, para terdakwa diancam pidana pada pasal 2 ayat (1) junto pasal 18 ayat (2) Undang-Undang Nomor 31 tahun 1999 pemberantasan Tipikor sebagaimana telah diubah dengan UU Nomor 20 tahun 2001 tentang perubahan atas UU Nomor 31 tahun 1999 tentang pemberantasan tindak pidana korupsi junto pasal 55 ayat (1) ke 1 KUHPidana.
Sedangkan untuk pasal 2, ancaman pidana minimal 4 tahun dan maksimal 20 tahun, serta denda paling sedikit 200 juta rupiah dan paling banyak 1 miliar rupiah.
“Untuk dakwaan subsidiar, para terdakwa diancam pidana dalam pasal 3 junto pasal 18 ayat (2) UU Nomor 31 tahun 1999 tentang pemberantasan tindak pidana korupsi sebagaimana telah diubah dengan UU Nomor 20 tahun 2001 tentang perubahan atas UU Nomor 31 tahun 1999 tentang pemberantasan tindak pidana korupsi junto pasal 55 ayat (1) ke 1 KUHPidana. Dan untuk pasal 3 pidana penjara paling singkat 1 tahun dan paling lama 20 tahun dan atau denda paling sedikit 50 juta rupiah dan maksimal 1 miliar,” jelasnya.
Terpisah, terdakwa Ferdi Parengkuan alias Ferdi melalui kuasa hukumnya, Rusdi Bachmid, usai persidangan menuturkan, pihaknya tidak lagi mengajukan tanggapan atas dakwaan JPU.
Begitu juga terdakwa Razak Karim melalui kuasa hukumnya, M. Afdal Hi. Anwar dan terdakwa Luthfi melalui kuasa hukumnya, Muhammad Konoras juga tidak lagi menanggapi dakwaan JPU.
Sidang akan dilanjutkan pada Rabu (9/3) pekan depan dengan agenda pemeriksaan saksi dari JPU.
Sekadar diketahui, proyek tersebut dianggarkan dari Anggaran Pendapatan dan Belanja Daerah (APBD) tahun 2018-2019 senilai 9,8 miliar lebih yang melekat pada Dinas PUPRKP Sula. Proyek ini dikerjakan di masa kepemimpinan Hendrata Theis. (gon/ask)
