PENAMALUT.COM, TERNATE – Kejaksaan Tinggi (Kejati) Maluku Utara tengah mengusut dugaan persekongkolan Balai Pelaksana Pemilinan Jasa Kontruksi (BP2JK) Malut yang telah memenangkan perusahaan daftar hitam (blacklist) dalam proyek penahan ombak senilai 43 miliar di Kabupaten Pulau Morotai.
Langkah Kejati ini mendapat dukungan dari Akademisi Universitas Khairun Ternate, Abdul Kadir Bubu. Pasalnya, langkah Kejati dianggap sangat tepat.
Menurut dosen Fakultas Hukum Unkhair ini, daftar hitam yang telah diumumkan di portal Lembaga Kebijakan Pengadaan Barang/Jasa Pemerintah (LKPP) merupakan pengumunan resmi yang memiliki konsekuensi hukum larangan bagi perusahaan bersangkutan.
Artinya bahwa untuk ikut tender saja tidak dibenarkan, karena melekat status daftar hitam (blacklist).
“Tapi kenyataannya perusahaan itu sebagai pemenang tender. Karena itu jelas ada permainan pihak penyelenggara tender dengan orang-orang dari perusahaan itu. Atas kesengajaan itu, maka pemenang tender itu harus dianulir (dibatalkan) dan bagi perusahaan lain yang dirugikan akibat karena permainan ini, segera laporkan ke pihak yang berwewenang untuk diproses hukum. Ini praktik kotor, jadi harus dibersihkan. Tdak boleh dibiarkan,” tegas Dade sapaan akrab Abdul Kadir Bubu kepada wartawan media ini, Kamis (20/1).
Kandidat Doktor Universitas Islam Indonesia (UII) menuturkan, sepanjang larangan itu belum dicabut, maka apapun yang dilakukan perusahaan itu dianggap tidak sah.
“Tepat kiranya jika Kejati masuk dan menyelidiki masalah ini, dan pengerjaan proyek tidak bisa dilaksanakan oleh perusahaan ini, karena telah di-blacklist,” tandasnya.
Sekadar diketahui, PT. Bumi Aceh Citra Persada yang beralamat di JI.T. Iskandar No. 88 – Banda Aceh masuk dalam daftar hitam (blacklist) dengan berlaku sanksi sejak 28 Desember 2021 sampai 28 Desember 2022 mendatang.
Namun anehnya, BP2JK Malut malah memenangkan perusahaan tersebut. Padahal dalam proyek tersebut terdapat enam perusahaan yang ikut tender, termasuk PT. Bumi Aceh Citra Persada.
Informasinya, ada dugaan persekongkolan antara petinggi BP2JK untuk memenangkan perusahaan tersebut.
Proyek senilai 43 miliar itu melekat pada Kementerian Pekerjaan Umum dan Perumahan Rakyat (PUPR), Satuan Kerja SNVT Pelaksanaan Jaringan Sumber Air Maluku, Provinsi Maluku Utara. (gon/ask)
