PENAMALUT.COM, TERNATE – PT. Hidup Baru Sejahtera (HBS) diadukan mantan karyawannya ke Dinas Tenaga Kerja (Disnaker) Kota Ternate atas Pemutusan Hubungan Kerja (PHK) dan tanpa pemberian pesangon oleh perusahaan.
MA, Eks karyawan PT. BHS mengadukan permasalahan tersebut ke Disnaker melalui Dewan Pimpinan Daerah (DPD) Serikat Pekerja Nasional (SPN) Maluku Utara yang didampingi Bendahara SPN Malut, Astuti N. Daeng Barang.
Astuti kepada wartawan mengatakan, pihak perusahan PT. BHS tidak memberikan pesangon kepada eks karyawannya lantaran perusahaan berdalil bahwa kerja di atas satu tahun tidak mendapatkan pesangon. Apa yang disampaikan pihak perusahaan ini sangat keliru dan tidak mengikuti perintah Undang-Undang Nomor 13 tahun 2003 tentang Ketenagakerjaan pasal 156.
“Pengaduan eks karyawan PT. BHS ke DPD SPN Malut dan akan kami tindaklanjuti. Keterangan eks karyawan ini bahwa perusahaan hanya memberikan insentif 500 ribu dan ucapan terima kasih Rp500 ribu. Jadi yang diterima eks karyawan HBS ini sebesar 1 juta rupiah,” ujarnya kepada wartawan, Selasa (7/12).
Astuti menambahkan, pihak SPN Malut akan melakukan pengaduan ke Disnaker Kota Ternate agar dirundingkan hal ini sesuai ketentuan UU Nomor 13 tahun 2003 tentang Ketenagakerjaan sebagaimana dijelaskan dalam pasal 151 ayat (2). Sebab eks karyawan yang bersangkutan sudah kerja lebih dari satu tahun.
Pada pasal tersebut diaebutkan bahwa dalam hal segala upaya telah dilakukan, tetapi pemutusan hubungan kerja tidak dapat dihindari, maka maksud pemutusan hubungan kerja wajib dirundingkan oleh pengusaha dan serikat pekerja/serikat buruh atau dengan pekerja/buruh apabila pekerja/buruh yang bersangkutan tidak menjadi anggota serikat pekerja/serikat buruh.
“Perundingan tersebut masuk dalam perselisihan PHK yang tidak mendapatkan uang pesangon. Karena itu, kepada semua karyawan di Kota Ternate bahwa ketika karyawan berkerja satu tahun atau lebih, maka karyawan tersebut mendapatkan pesangon dan hak lain,” jelasnya. (gon/ask
