PENAMALUT.COM, JAILOLO – Mantan Kepala Desa Bobane Dano, Kabupaten Halmahera Barat, Seblum Babua, akhirnya ditahan Kejaksaan Negeri (Kejari) Halbar atas dugaan korupsi anggaran desa tahun 2017.
Penahanan Seblum ini menyusul berkas perkara dugaan korupsi dinyatakan lengkap oleh jaksa peneliti. Kini berkas dan tersangka diserahkan ke Jaksa Penuntut Umum (JPU) Kejari Halbar pada Rabu (1/12) tadi.
Ini artinya, tidak lama lagi Seblum akan diadili di persidangan atas dugaan kasus tersebut.
Kepala Seksi Pidana Khusus (Pidsus) Kejari Halbar, Galih Martino Dwi Cahyo menjelaskan, dugaan kasus tipikor dengan tersangka mantan Kades Bobane Dano sudah dilakukan penyerahan dari jaksa penyelidik ke JPU sesuai dengan petunjuk P.16A Kejari Halbar.
Dalam kasus ini, Seblum diduga merugikan keuangan Negara sebesar Rp 306.838.159,89 berdasarkan perhitungan kerugian Negara.
“Dari hasil pemeriksaan berkas penyidik Nomor: PDS-01/0.2.17.4/Fd.2/10/2021 tertanggal 28 Oktober 2021 beserta barang bukti, tersangka terbukti secara sah dan meyakinkan melakukan perbuatan-perbuatan melawan hukum. Sehingga dianggap perlu untuk dilakukan penahanan,” jelasnya.
Galih menambahkan, penahanan yang dilakukan terhadap tersangka selama 20 hari terhitung sejak tanggal yang ditetapkan. Ini berdasarkan surat perintah Kejari Halbar Nomor: PRINT 398 /0.2.17.4/Fd.2/12/2021 tertanggal 1 Desember 2021. Tersangka kini sudah dititipkan di Lembaga Permasyarakatan (Lapas) kelas II B Jailolo.
Untuk mempertanggungjawabkan perbuatan terdakwa sebagaimana diatur dan diancam dalam Pasal 2 ayat (1) junto Pasal 18 ayat (1) huruf b Undang-Undang RI Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi sebagaimana diubah dan ditambah dengan Undang-Undang RI Nomor 20 Tahun 2001 tentang Perubahan Atas Undang-Undang RI Nomor 31 Tahun 1999, Pasal 3 Junto Pasal 18 ayat (1) huruf b Undang-Undang RI Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi sebagaimana diubah dan ditambah dengan Undang-Undang RI Nomor 20 Tahun 2001 tentang Perubahan Atas Undang-Undang RI Nomor 31 Tahun 1999.
“Ancaman hukuman minimal 1 tahun kurungan penjara dan maksimal 20 tahun hingga seumur hidup dan denda paling sedikit 50 juta dan paling banyak 1 miliar,” jelasnya. (adi/ask)
