Introduction to the EU Succession Regulation

This course aims to provide an exhaustive analysis of the EU Succession Regulation in light of the European Court of Justice's judgments about this instrument. Following the structure of the Succession Regulation, the course dedicates one session for each part of this instrument, from its jurisdictional regime to the European Certificate of Succession.

About this course

The EU Succession Regulation (Regulation no 650/2012) sets out a unitary regime applicable to cross-border succession cases as it deals with the whole estate and does not make a differentiation between types of property: moveable and immovable property. At the same time, the Regulation provides uniform rules regarding jurisdiction, applicable law, recognition, and enforcement, also establishing the European Certificate of Succession.

This course aims to provide an exhaustive analysis of the Succession Regulation in light of the European Court of Justice’s judgments about this instrument. Following the structure of the Succession Regulation, it dedicates one session for each part of this instrument, from its jurisdictional regime to the European Certificate of Succession.

What will you learn:

You will have the opportunity to learn the following:

  • the scope of application of the Succession Regulation
  • what rules determine the applicable law to a succession
  • the recognition and enforcement regime of the Succession Regulation
  • the issuance and characters of the European Certificate of Succession
  • the most relevant contributions of the European Court of Justice case law to the interpretation of the Succession Regulation

Course methodology/highlights:

The course offers a theoretical analysis of the Succession Regulation, putting a particular focus on the European Court of Justice case law on this instrument. The referred theoretical analysis is complemented by a case study that the participants will solve with the guidance provided by the trainers.
The course follows an interactive approach, giving room for participants to intervene in each session, while trainers will often ask questions to trigger discussions among participants.

This course is designed to provide participants with the necessary knowledge to understand the scope of the Succession Regulation, how it is applied, and the difficulties that one might encounter in practice.

Prior to the course, you will be given access to the course materials on our digital learning platform. Such materials include institutional documents about the Succession Regulation, all the European Court of Justice case law that exists to that date on the instrument as well as relevant scientific articles on the topic. It also includes a short questionnaire, which will help us identify any specific questions you may have so we can consider as many of them as possible during the course.

Preparatory reading and materials will be available on the platform to facilitate joining the course. All course materials will be made available for the participants.

This course might be of particular interest to:

  • lawyers and other private legal practitioners who deal with cross-border claims;
  • judges and court clerks;
